According to reporting from Channel 13 WREX, a motorcyclist has been seriously injured in an accident on Alpine Road. Local police report that the crash took place on the afternoon of March 24th, when a biker lost control of his motorcycle and slid into two other vehicles. Witnesses at the scene of the accident speculated that the motorcycle’s brakes may have malfunctioned, preventing the biker from stopping. Emergency crews reported that the unidentified motorcyclist was taken to an area hospital with serious head injuries. The motorcycle accident is still under investigation.
Personal injury cases in Illinois, including motorcycle accident cases, are governed by the state’s modified comparative negligence rules. Under this standard, the party, or parties, that are responsible for an accident will be held legally liable for the resulting damages. As most motor vehicle accidents are caused by human error, most often a driver is the negligent party in a motorcycle accident case. However, other parties can also be held liable. Indeed, manufacturers and even government entities may bear liability for a crash. In the aforementioned Rockford motorcycle accident case, the witness reports of possible brake issues warrant additional investigation to determine if the manufacturer is to blame. Â
For several different reasons, manufacturer liability claims can be especially complex. First, there are usually multiple different companies that manufacture different parts on a bike. As such, extensive investigation is typically required to determine the precise cause of the problem. Additionally, manufacturers often fight aggressively to defend these type of claims. If you were injured in a motorcycle accident, or any other type of motor vehicle crash, and you think that a defective ‘part’ contributed to the wreck, you need to contact a qualified personal injury attorney immediately.
