The question of fault or negligence will dominate any personal injury claim. This includes car accidents. In Illinois, you can only sue the other driver if your fault is less than theirs. In other words, the other driver must be 51% at fault or more. But this does not mean you are out of luck. You can make a claim against your own policy if you carry personal injury protection (PIP).
If the other driver is at fault, you need to prove they are at fault. This requires not only the police report (which is not always correct) but tracking down witnesses and using physical evidence from the scene to make your point. In some cases, this is relatively straightforward, but the insurance company has a fiduciary duty to protect their policyholder and a good amount of self-interest to boot. This means exploiting ambiguities in the record to argue in favor of their client or using a lack of information against you.
